<p class="wp-block-paragraph">In March 2025, Flock Safety raised $275 million in a funding round led by Andreessen Horowitz (a16z), valuing the surveillance company at $7.5 billion. Flock has now raised over $950 million total and crossed $300 million in annual recurring revenue.</p>



<p class="wp-block-paragraph">But here’s what they’re not telling you.</p>

<p class="wp-block-paragraph">Andreessen Horowitz is also backing&nbsp;<strong>Toka</strong>—an Israeli cyber-intelligence firm co-founded by&nbsp;<strong>Ehud Barak</strong>, Israel’s former PM and Epstein handler.</p>



<p class="wp-block-paragraph">Toka is not a surveillance company. Toka is a&nbsp;<em>hacking</em>&nbsp;company. According to a 2022 Haaretz investigation, Toka’s tools allow government clients to locate networked cameras in a target area, hack into them, watch live feeds, and&nbsp;<strong>alter or erase both live and recorded footage</strong>—without leaving forensic traces.</p>



<h2 class="wp-block-heading" id="h-discover-hack-alter">“Discover, Hack, Alter”</h2>



<p class="wp-block-paragraph">Toka’s business model is simple. Its core capabilities are listed as “Discover, Hack, and Alter”&nbsp;<a href="https://www.secrss.com/articles/50393" target="_blank" rel="noreferrer noopener"></a>. The company’s technology can locate security cameras and even webcams within a given range, infiltrate them, watch their feeds, and change both real-time video and past recordings.</p>



<p class="wp-block-paragraph">Imagine the implications. Your alibi? Deleted. The footage that proves your innocence? Altered. And no one would ever know.</p>

<h2 class="wp-block-heading" id="h-the-a16z-pipeline">The A16z Pipeline</h2>



<p class="wp-block-paragraph">The connection runs deeper than money. Since 2024, Andreessen Horowitz has pivoted aggressively toward the Israeli market, hosting exclusive Tel Aviv events designed to recruit graduates from elite Israeli intelligence units—specifically&nbsp;<strong>Unit 8200</strong>&nbsp;and&nbsp;<strong>Unit 81</strong>&nbsp;<a href="https://www.linkedin.com/posts/trtworld_how-epsteins-israeli-network-extends-well-activity-7432128637933527040-zZrA" target="_blank" rel="noreferrer noopener"></a>. These units are taxpayer-funded incubators for startups that are later capitalized by a16z.</p>



<p class="wp-block-paragraph">This isn’t speculation. TechCrunch reported that Toka is actively hiring a “Client Director USA” to support “new business growth within the US government market,” specifically targeting the Department of Defense and national security agencies&nbsp;<a href="https://techcrunch.com/2024/12/06/a16z-backed-toka-wants-to-help-us-agencies-hack-into-security-cameras-and-other-iot-devices/?_hsmi=337454692" target="_blank" rel="noreferrer noopener"></a>. They’re also hiring a customer success engineer experienced with federal law enforcement.</p>



<h2 class="wp-block-heading" id="h-toka-targets-u-s-law-enforcement">Toka Targets U.S. Law Enforcement</h2>



<p class="wp-block-paragraph">Toka has publicly stated it only sells to “militaries, homeland security organizations, intelligence, and law enforcement agencies in the United States and its closest allies”.</p>



<p class="wp-block-paragraph">The company is listed as attending conferences in the UAE and has hired a vice president of international sales who previously worked for Cellebrite, another controversial Israeli cyber firm&nbsp;<a href="https://techcrunch.com/2024/12/06/a16z-backed-toka-wants-to-help-us-agencies-hack-into-security-cameras-and-other-iot-devices/?_hsmi=337454692" target="_blank" rel="noreferrer noopener"></a>. In 2021, Toka was in talks with U.S. Special Operations Command and an unnamed U.S. intelligence agency.</p>



<p class="wp-block-paragraph"><strong>The same venture capital firm that controls America’s largest police camera network is funding the company that can hack into them.</strong></p>



<h2 class="wp-block-heading" id="h-the-nightmare-scenario">The Nightmare Scenario</h2>



<p class="wp-block-paragraph">Flock places 100,000 cameras across America, available to 5,000 law enforcement agencies&nbsp;<a href="https://techcrunch.com/2025/03/13/y-combinators-police-surveillance-darling-flock-safety-raises-275m-at-7-5b-valuation/?utm_source=mainstreetmemos.beehiiv.com&amp;utm_medium=newsletter&amp;utm_campaign=greatest-of-all-time&amp;_bhlid=b264812529a508ac0eb0d6356a33e4a3ed92af16" target="_blank" rel="noreferrer noopener"></a><a href="https://www.chaincatcher.com/en/article/2172512" target="_blank" rel="noreferrer noopener"></a>. Toka can hack into cameras, alter footage, and erase evidence.</p>



<p class="wp-block-paragraph">Two companies. One investor. Zero oversight.</p>



<p class="wp-block-paragraph">A license plate reader on a golf course makes no sense. A people tracker on a golf course makes perfect sense—if you’re building a mass surveillance state. And when the footage can be altered? That’s not surveillance. That’s control.</p>



<p class="wp-block-paragraph"><strong>As one report put it: “You could be arrested based on video that never happened.”</strong></p>

<p class="wp-block-paragraph">The allegations have fueled fears that emerging surveillance technologies could one day be weaponized to fabricate evidence or conceal criminal activity.</p>



<p class="wp-block-paragraph">Flock Safety operates one of the nation’s fastest-growing automated license plate reader (ALPR) networks, with tens of thousands of AI-powered cameras tracking vehicle movements across the United States.</p>



<p class="wp-block-paragraph">Meanwhile,&nbsp;<a href="https://www.haaretz.com/israel-news/security-aviation/2022-12-26/ty-article-magazine/.premium/this-dystopian-cyber-firm-could-have-saved-mossad-assassins-from-exposure/00000185-0bc6-d26d-a1b7-dbd739100000">Israeli cyber firm Toka</a>&nbsp;has developed technology that reportedly enables government clients to hack internet-connected security cameras, monitor live video feeds, and even manipulate both live and previously recorded footage.</p>



<p class="wp-block-paragraph">The reported overlap has sparked intense debate online about the risks of combining mass surveillance with increasingly sophisticated cyber capabilities.</p>



<p class="wp-block-paragraph"><strong>Report Highlights Alleged Investment Link</strong></p>



<p class="wp-block-paragraph">According to&nbsp;<a href="https://www.gadgetreview.com/flocks-lead-investor-also-backs-a-company-that-can-alter-security-footage">Gadget Review</a>,&nbsp;<a href="https://techcrunch.com/2025/03/13/y-combinators-police-surveillance-darling-flock-safety-raises-275m-at-7-5b-valuation/">Bedrock Capital</a>&nbsp;led Flock Safety’s $275 million funding round.</p>



<p class="wp-block-paragraph">The outlet also examined claims circulating on social media alleging that Bedrock has ties to Toka.</p>



<p class="wp-block-paragraph">“Bedrock Capital leads Flock Safety’s $275M round while alleged ties to Toka, which reportedly erases camera footage without a trace, draw scrutiny,” Gadget Review reported.</p>



<p class="wp-block-paragraph">An&nbsp;<a href="https://x.com/OrwellDay/status/2084701148095926288">X post</a>&nbsp;from user @OrwellDay alleged that Flock’s lead investor also backs Toka.</p>



<p class="wp-block-paragraph">However, Gadget Review noted that while Flock’s investors are well documented, publicly available evidence does not currently confirm whether those same investors also hold a stake in Toka.</p>



<p class="wp-block-paragraph">“That gap between allegation and evidence is the story—not a footnote,” the outlet wrote.</p>



<p class="wp-block-paragraph"><strong>Israeli Firm Reportedly Can Alter Security Camera Footage</strong></p>



<p class="wp-block-paragraph">Toka first drew international attention in 2022 after an investigation by Israeli newspaper Haaretz detailed the company’s capabilities.</p>



<p class="wp-block-paragraph">According to the&nbsp;<a href="https://www.haaretz.com/israel-news/security-aviation/2022-12-26/ty-article-magazine/.premium/this-dystopian-cyber-firm-could-have-saved-mossad-assassins-from-exposure/00000185-0bc6-d26d-a1b7-dbd739100000">report</a>, Toka was co-founded by former Israeli Prime Minister Ehud Barak and retired Israel Defense Forces cyber chief Brig. Gen. Yaron Rosen.</p>



<p class="wp-block-paragraph">Haaretz reported that the company develops cyber tools allowing government customers to locate internet-connected security cameras within a specific area, gain unauthorized access to those cameras, monitor live video, and alter both live and archived footage.</p>



<p class="wp-block-paragraph">The publication reported that Toka works almost exclusively with government agencies, intelligence services, and law enforcement organizations.</p>



<p class="wp-block-paragraph">Israel’s Defense Ministry regulates its activities.</p>



<p class="wp-block-paragraph">As of 2021, internal documents reviewed by Haaretz indicated the company held contracts worth approximately $6 million with the Israeli government while seeking to expand those deployments.</p>



<p class="wp-block-paragraph"><strong>Flock’s Surveillance Network Continues to Expand</strong></p>



<p class="wp-block-paragraph">Flock Safety’s&nbsp;<a href="https://allmotornews.com/flock-safety-camera-poles-fail-federal-breakaway-standards/">controversial</a>&nbsp;AI-powered camera system has rapidly spread across the United States.</p>



<p class="wp-block-paragraph">According to&nbsp;<a href="https://www.gadgetreview.com/san-jose-has-a-flock-problem-nomark-may-be-the-folk-hero-it-needs">Gadget Review</a>, the company retains vehicle data for roughly 30 days, allowing participating law enforcement agencies to search historical vehicle movements.</p>



<p class="wp-block-paragraph">Flock maintains that its system tracks vehicles rather than individuals.</p>



<p class="wp-block-paragraph">Privacy advocates argue that distinction offers little reassurance because vehicles typically reveal where people live, work, worship, travel, and socialize.</p>



<p class="wp-block-paragraph">Independent security researchers have also claimed that certain Flock camera hardware can reportedly be physically compromised in under 30 seconds, potentially exposing credentials and video streams.</p>



<p class="wp-block-paragraph">Those findings have not been independently verified by government regulators.</p>

<p class="wp-block-paragraph">Concerns over surveillance systems extend well beyond any one company.</p>



<p class="wp-block-paragraph">Researchers have repeatedly demonstrated that internet-connected security cameras can be compromised.</p>



<p class="wp-block-paragraph">In 2019, Forbes&nbsp;<a href="https://www.forbes.com/sites/leemathews/2019/07/30/researchers-hack-video-surveillance-system-and-swap-in-fake-footage/">detailed</a>&nbsp;how researchers successfully hacked surveillance systems and replaced live camera feeds with prerecorded footage.</p>



<p class="wp-block-paragraph"></p>



<p class="wp-block-paragraph">Since then, rapid advances in artificial intelligence have dramatically expanded the ability to generate highly realistic synthetic video.</p>



<p class="wp-block-paragraph">Cybersecurity experts have also&nbsp;<a href="https://www.securityweek.com/vulnerability-allows-hackers-to-remotely-tamper-with-dahua-security-cameras/">identified</a>&nbsp;vulnerabilities across numerous commercial surveillance platforms.</p>



<p class="wp-block-paragraph">One of the most high-profile incidents occurred in 2021 when hackers breached cloud-based surveillance company Verkada.</p>



<p class="wp-block-paragraph">According to the American Civil Liberties Union (ACLU), attackers gained access to approximately 150,000 cameras installed inside hospitals, schools, prisons, police stations, offices, gyms, and women’s health clinics.</p>



<p class="wp-block-paragraph">The hackers&nbsp;<a href="https://www.aclu.org/news/civil-liberties/major-hack-of-camera-company-offers-four-key-lessons-on-surveillance">reportedly</a>&nbsp;viewed live feeds from highly sensitive locations, including patient rooms inside hospitals.</p>



<p class="wp-block-paragraph">The ACLU warned that cloud-connected surveillance networks create centralized targets capable of exposing enormous volumes of private video if compromised.</p>

<p class="wp-block-paragraph">The expansion of AI surveillance is no longer limited to fixed camera systems.</p>



<p class="wp-block-paragraph">Gadget Review recently&nbsp;<a href="https://www.gadgetreview.com/starting-this-september-drones-will-scan-license-plates-over-lancaster-ny">reported</a>&nbsp;that police in Lancaster, New York, plan to begin&nbsp;<a href="https://www.cityoflancasterca.org/Home/Components/News/News/10442/">deploying drones</a>&nbsp;capable of livestreaming neighborhoods while automatically recording license plates from the air.</p>



<p class="wp-block-paragraph">The program is expected to begin in September.</p>



<p class="wp-block-paragraph">Combined with increasingly sophisticated AI systems, expanding surveillance infrastructure, and documented cyber vulnerabilities, critics argue the technology raises profound questions about privacy, accountability, and the integrity of digital evidence.</p>



<p class="wp-block-paragraph">While the reported financial link between Flock Safety’s investors and Toka remains unconfirmed, the broader concern extends far beyond any single company.</p>



<p class="wp-block-paragraph">As surveillance networks continue expanding nationwide, many observers warn that hacked cameras, manipulated footage, and AI-generated video could eventually pose challenges for law enforcement, the courts, and public trust.</p>

<p>EVERETT — The city of Stanwood has paused use of its Flock cameras in light of questions over whether footage is subject to public records requests under state law.</p>
<p>The Stanwood City Council approved its $92,000 contract with Flock Safety in November 2024. In February, the city installed 14 automatic license plate reading cameras. The cameras were operating for about four months before the city turned them off in May, City Administrator Shawn Smith said.</p>
<p>In April, an individual requested all Flock camera footage in Stanwood within a one-hour window on March 30. In light of the request, the city decided in June to seek a court judgment that Flock footage either is not public record or is exempt from the public records act for privacy reasons.</p>
<p>Stanwood is seeking the judgment along with the city of Sedro-Woolley, which also received a records request for Flock footage from the same individual, Jose Rodriguez. The cities filed the complaint in Skagit County Superior Court.</p>
<p>In response, Rodriguez filed a lawsuit against Stanwood in Snohomish County Superior Court, alleging the city is violating the Public Records Act by not providing the footage.</p>
<p>“No exemption to the PRA requirements apply in this case and public policy favors timely disclosure, and in no way hinders disclosure, of the records requested,” the complaint read.</p>
<p>All Flock camera footage is stored in the Flock Safety cloud system, Stanwood and Sedro-Woolley attorneys wrote in their complaint. Cities only have access to data the officers search for, the complaint read. Stanwood and Sedro-Woolley argue that Flock footage is only public record once a public agency extracts and downloads the data. The Public Records Act states that public records include information <a href="https://app.leg.wa.gov/rcw/default.aspx?cite=42.56.010" target="_blank" rel="noopener" data-mrf-link="https://app.leg.wa.gov/rcw/default.aspx?cite=42.56.010">“prepared, owned, used, or retained”</a> by an agency.</p>
<p>“Requiring public agencies to generate a new search in the Flock cloud system for the sole purpose of accessing and downloading data requested under the PRA, data which the agency had not previously accessed, would require the agency to create new public records not in existence at the time of the request,” the complaint read.</p>
<p>If a judge decides the footage is public record, the cities argue it should still be exempt from requests under the Public Records Act. The law <a href="https://app.leg.wa.gov/rcw/default.aspx?cite=42.56.240" target="_blank" rel="noopener" data-mrf-link="https://app.leg.wa.gov/rcw/default.aspx?cite=42.56.240">exempts certain intelligence information</a> that could jeopardize the effectiveness of law enforcement or a person’s right to privacy if released.</p>
<p>“If the data becomes public record, that would allow nefarious actors to carry out their act,” Stanwood resident Tim Schmitt said in a July interview. “So imagine tracking your ex-spouse or a person you broke up with under difficulty, it would allow all sorts of malicious mischief against innocent individuals.”</p>
<p>Schmitt is a member of the Stanwood City Council and said his opinions do not reflect those of the council or the city.</p>

<p>State law does not explicitly exempt automated license plate reader data from public records. It does have explicit <a href="https://app.leg.wa.gov/RCW/default.aspx?cite=46.63.220" target="_blank" rel="noopener" data-mrf-link="https://app.leg.wa.gov/RCW/default.aspx?cite=46.63.220">exemptions for red-light camera data</a>. In July, Stanwood City Attorney wrote a letter to State Sen. Ron Muzzall, R-Oak Harbor, asking him to sponsor or support legislation to create a specific exemption for automated license plate reader data in the Public Records Act.</p>
<p>Schmitt was the sole vote against the Flock contract in November 2024. Part of the reason for his vote, he said, was uncertainty over public records laws.</p>
<p>“I had this doubt in the back of my mind,” he said.</p>
<p>Schmitt also raised concerns that the contract was too expensive, especially compared to other cities, he said. For example, Mount Vernon has six Flock cameras for a population of about 35,000 and a land area of about 12 square miles. Stanwood has 14 cameras for a population of about 8,000 and a land area of about 3 square miles.</p>
<p>While the cameras are turned off, Stanwood is not currently making payments to Flock Safety, Smith said.</p>
<p>In Stanwood, Flock cameras have helped identify a shoplifter that stole $1,000 from small businesses, apprehend a suspect in a shooting in a neighboring jurisdiction and locate an elderly person with dementia within 10 minutes, the complaint read.</p>
<p>The litigation comes as cities across the state and country continue to sign contracts with Flock Safety. According to the company, the cameras are operating in <a href="https://www.flocksafety.com/products/national-lpr-network" target="_blank" rel="noopener" data-mrf-link="https://www.flocksafety.com/products/national-lpr-network">more than 5,000 communities </a><a href="https://www.flocksafety.com/products/national-lpr-network" target="_blank" rel="noopener" data-mrf-link="https://www.flocksafety.com/products/national-lpr-network">nationwide</a>. Most cities in Snohomish County have implemented Flock cameras within the past year.</p>

The City Council <a href="https://www.heraldnet.com/news/mountlake-terrace-approves-flock-camera-system-after-public-pushback/" target="_blank" rel="noopener" data-mrf-link="https://www.heraldnet.com/news/mountlake-terrace-approves-flock-camera-system-after-public-pushback/">voted to approve a contract</a> with Flock Safety in June.</p>
<p>At a <a href="https://www.youtube.com/watch?v=FvXzAHHI-lw&amp;t=6276s" target="_blank" rel="noopener" data-mrf-link="https://www.youtube.com/watch?v=FvXzAHHI-lw&amp;t=6276s">Sept.</a> <a href="https://www.youtube.com/watch?v=FvXzAHHI-lw&amp;t=6276s" target="_blank" rel="noopener" data-mrf-link="https://www.youtube.com/watch?v=FvXzAHHI-lw&amp;t=6276s">4 meeting</a>, Mountlake Terrace City Council member William Paige Jr. expressed regret for voting for the contract in June. Last month, Flock CEO Garrett Langley <a href="https://www.flocksafety.com/blog/ensuring-local-compliance" target="_blank" rel="noopener" data-mrf-link="https://www.flocksafety.com/blog/ensuring-local-compliance">wrote in an Aug. 25 statement</a> it had pilot programs with U.S. Customs and Border Patrol and Homeland Security Investigations. The program was intended to help combat human trafficking and fentanyl distribution, Langley said. The company has since paused the program, he said.</p>
<p>“We clearly communicated poorly,” Langley said. “We also didn’t create distinct permissions and protocols in the Flock system to ensure local compliance for federal agency users. I appreciate the sensitivities surrounding local and federal cooperation on law enforcement matters, and I understand that in order to allow communities to align with their laws and societal values, these definitions and product features are critical.”</p>
<p>At the Sept. 4 meeting, Paige said he doesn’t trust Flock Safety and no longer wants to do business with the company.</p>
<p>“We all heard concerns that day — and before and after that day — from the community about making sure Homeland Security and Customs and Border Protection would not have access to our data,” Paige said. “We had a Flock representative right here listening to those concerns. And yet, at that same time, Flock already had a contract that allowed those federal agencies to access data. They never shared that with us.”</p>

<p>The Skagit County Superior Court in Washington rejected the attempt to block the public’s right to access data gathered by Flock Safety cameras, protecting access to information under the Washington Public Records Act (PRA). Importantly, the ruling from the court makes it clear that this access is protected even when a Washington city uses Flock Safety, a third-party vendor, to conduct surveillance and store personal data on behalf of a government agency.</p>
<p>&#8220;The Flock images generated by the Flock cameras&#8230;are public records,&#8221; the court wrote in <a href="https://www.documentcloud.org/documents/26223229-20251106-ruling-25-2-00717-29-city-of-sedro-woolley-et-al-vs-jose-rodriguez/">its ruling</a>. &#8220;Flock camera images are created and used to further a governmental purpose. The Flock images created by the cameras located in Stanwood and Sedro-Woolley were paid for by Stanwood and Sedro Wooley [sic] and were generated for the benefit of Stanwood and Sedro-Woolley.&#8221;</p>
<p>The cities’ move to exempt the records from disclosure was a dangerous attempt to deny transparency and reflects another problem with the massive amount of data that police departments collect through Flock cameras and store on Flock servers: the wiggle room cities seek when public data is hosted on a private company’s server.</p>
<p>Flock Safety&#8217;s main product is ALPRs, camera systems installed throughout communities to track all drivers all the time. Privacy activists and journalists across the country recently have used public records requests to obtain data from the system, <a href="https://www.eff.org/deeplinks/2025/11/license-plate-surveillance-logs-reveal-racist-policing-against-romani-people">revealing a variety of controversial uses</a>. This has included agencies <a href="https://www.eff.org/deeplinks/2025/10/flock-safety-and-texas-sheriff-claimed-license-plate-search-was-missing-person-it">accessing data for immigration enforcement and to investigate an abortion</a>, the latter of which may have violated Washington law. <a href="https://jsis.washington.edu/humanrights/2025/10/21/leaving-the-door-wide-open/">A recent report from the University of Washington</a> found that some cities in the state are also sharing the ALPR data from their Flock Safety systems with federal immigration agents.</p>
<p>In this case, a member of the public in April <a href="https://www.heraldnet.com/news/stanwood-pauses-flock-cameras-amid-public-records-lawsuits/">filed a records request with a Flock customer</a>, the City of Stanwood, for all footage recorded during a one-hour period in March. Shortly afterward, Stanwood and another Flock user, the City of Sedro-Woolley <a href="https://www.scribd.com/document/901263718/City-of-Sedro-Woolley-v-Jose-Rodriguez-Complaint-for-Declaratory-Judgement">requested the local court rule that this data is not a public record</a>, asserting that “data generated by Flock [automated license plate reader cameras (ALPRs)] and stored in the Flock cloud system are not public records unless and until a public agency extracts and downloads that data.&#8221;</p>
<p>If a government agency is conducting mass surveillance, EFF supports individuals’ access to data collected specifically on them, at the very least. And to address legitimate privacy concerns, governments can and should redact personal information in these records while still disclosing information about how the systems work and the data that they capture.</p>
<p>This isn’t what these Washington cities offered, though. They tried a few different arguments against releasing any information at all.</p>
<p><a href="https://www.scribd.com/document/901263718/City-of-Sedro-Woolley-v-Jose-Rodriguez-Complaint-for-Declaratory-Judgement">The contract between</a> the City of Sedron-Woolley and Flock Safety clearly states that &#8220;As between Flock and Customer, all right, title and interest in the Customer Data, belong to and are retained solely by Customer,” and “Customer Data” is defined as &#8220;the data, media, and content provided by Customer through the Services. For the avoidance of doubt, the Customer Data will include the Footage.&#8221; Other Flock-using police departments across the country have also relied on similar contract language to insist that footage captured by Flock cameras belongs to the jurisdiction in question.</p>
<p>The contract language notwithstanding, officials in Washington attempted to restrict public access by claiming that video footage stored on Flock’s servers and requests for that information would constitute the generation of a new record. This part of the argument claimed that any information that was gathered but not otherwise accessed by law enforcement, including thousands of images taken every day by the agency’s 14 Flock ALPR cameras, had nothing to do with government business, would generate a new record, and should not be subject to records requests. The cities shut off their Flock cameras while the litigation was ongoing.</p>
<p>If the court had ruled in favor of the cities’ claim, police could move to store all their data — from their surveillance equipment and otherwise — on private company servers and claim that it&#8217;s no longer accessible to the public.</p>
<p>The cities threw another reason for withholding information at the wall to see if it would stick, claiming that even if the court found that data collected on Flock cameras are in fact public record, the cities should still be able to block the release of the requested one hour of footage either because all of the images captured by Flock cameras are sensitive investigation material or because they should be treated the same way as <a href="https://app.leg.wa.gov/RCW/default.aspx?cite=46.63.220">automated traffic safety cameras</a>.</p>
<p>EFF is particularly opposed to this line of reasoning. In 2017, <a href="https://www.eff.org/press/releases/electronic-frontier-foundation-aclu-win-court-ruling-police-cant-keep-license-plate#:~:text=EFF%20filed%20public%20records%20requests,be%20scrutinized%20and%20better%20understood.">the California Supreme Court sided with EFF and ACLU</a> in a case arguing that “the license plate data of millions of law-abiding drivers, collected indiscriminately by police across the state, are not ‘investigative records’ that law enforcement can keep secret.”</p>
<p>Notably, when Stanwood Police Chief Jason Toner made <a href="https://www.documentcloud.org/documents/24667420-city-council-meeting/#document/p8">his pitch to the City Council to procure</a> the Flock cameras in April 2024, he was adamant that the ALPRs would <i>not</i> be the same as traffic cameras. “Flock Safety Cameras are not ‘red light’ traffic cameras nor are they facial recognition cameras,” Chief Toner wrote at the time, adding that the system would be a “force multiplier” for the department.</p>
<p>If the court had gone along with this part of the argument, cities could have been able to claim that the mass surveillance conducted using ALPRs is part of undefined mass investigations, pulling back from the public huge amounts of information being gathered without warrants or reason.</p>
<p>The cities seemed to be setting up contradictory arguments. Maybe the footage captured by the cities’ Flock cameras belongs to the city — or maybe it doesn’t until the city accesses it. Maybe the data collected by the cities’ taxpayer-funded cameras are unrelated to government business and should be inaccessible to the public — or maybe it’s all related to government business and, specifically, to sensitive investigations, presumably of every single vehicle that goes by the cameras.</p>
<p>The requester, Jose Rodriguez, still won’t be getting his records, despite the court’s positive ruling.</p>
<p>“The cities both allowed the records to be automatically deleted after I submitted my records requests and while they decided to have their legal council review my request. So they no longer have the records and can not provide them to me even though they were declared to be public records,” Rodriguez told <a href="https://www.404media.co/judge-rules-flock-surveillance-images-are-public-records-that-can-be-requested-by-anyone/">404 Media</a> — another possible violation of that state’s public records laws.</p>
<p>Flock Safety and its ALPR system have come under increased scrutiny in the last few months, as the public has become aware of illegal and widespread sharing of information.</p>
<p>The <a href="https://www.404media.co/a-texas-cop-searched-license-plate-cameras-nationwide-for-a-woman-who-got-an-abortion/">system was used by the Johnson County Sheriff’s Office</a> to track someone across the country who’d self-administered an abortion in Texas. Flock repeatedly claimed that this was inaccurate reporting, but <a href="https://www.eff.org/deeplinks/2025/10/flock-safety-and-texas-sheriff-claimed-license-plate-search-was-missing-person-it">materials recently obtained by EFF</a> have affirmed that Johnson County was investigating that individual as part of a fetal death investigation, conducted at the request of her former abusive partner. They were not looking for her as part of a missing person search, as Flock said.</p>
<p>In <a href="https://capitolnewsillinois.com/news/hundreds-of-police-departments-use-camera-company-accused-of-breaking-state-law/">Illinois</a>, the Secretary of State <a href="https://www.ilsos.gov/content/dam/news/2025/august/250825d1.pdf">conducted an audit of Flock use</a> within the state and found that the Flock Safety system was facilitating Customs and Border Protection access, in violation of state law. And in <a href="https://www.king5.com/article/syndication/associatedpress/california-sues-says-el-cajon-police-are-illegally-sharing-license-plate-info-with-other-agencies/616-5cb49b00-63cf-4893-9760-42b30d0d7ef7">California</a>, the Attorney General recently sued the City of El Cajon for using Flock to illegally share information across state lines.</p>
<p>Police departments are <a href="https://www.eff.org/deeplinks/2025/04/beware-bundle-companies-are-banking-becoming-your-police-departments-favorite">increasingly relying on third-party vendors</a> for surveillance equipment and storage for the terabytes of information they’re gathering. Refusing the public access to this information undermines public records laws and the assurances the public has received when police departments set these powerful spying tools loose in their streets. While it’s great that these records remain public in Washington, communities around the country must be swift to reject similar attempts at blocking public access.</p>
